Eatling Terms of Service

Welcome to Eatling (“Eatling,” “we,” “us,” or “our”). Eatling is a meal-tracking product that uses a pet-style experience to help you log meals more consistently (think: a friendly habit loop, not a medical device).
By accessing or using Eatling (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.
1. Who We Are

2. Eligibility
You must be at least 13 years old to use the Service (or the minimum age required in your country). If you are under the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. The Service and What It Is Not
Eatling helps you log meals and build consistency through a pet-based interaction model.
Eatling is not a medical service. We do not provide medical advice, diagnosis, or treatment. Any insights, nudges, or recommendations are for general informational and habit-support purposes only. If you have health concerns, consult a qualified healthcare professional.
5. Your Content and Data
5.1 Your Content
You may submit content such as meal logs, notes, photos, and other information (“User Content”).
You retain ownership of your User Content. You grant us a limited license to host, store, process, and display your User Content only as needed to operate and improve the Service.
5.2 Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.
6. Acceptable Use
You agree not to:
- Use the Service for illegal or harmful purposes.
- Attempt to reverse engineer, hack, disrupt, or overload the Service.
- Upload malware or malicious code.
- Violate others’ privacy or intellectual property rights.
- Abuse the pet/habit system to create spam or automated activity that harms the Service.
We can suspend or terminate accounts that violate these Terms.
7. Subscriptions, Billing, and Payments (If Applicable)
Eatling may offer paid features via subscription or one-time purchases (“Paid Features”).
- Pricing, billing cycle, and what’s included will be shown at purchase.
- Payments are handled by the app store or payment provider you use (e.g., Apple).
- If you cancel, you keep access until the end of the billing period (unless your store terms say otherwise).
- Taxes may apply depending on your region.
Refunds are handled according to the platform you purchased through (e.g., Apple App Store rules).
8. Free Trials and Promotions (If Applicable)
If we offer trials or promotions:
- Trials convert to paid subscriptions unless canceled before the trial ends.
- Promotions may be limited, non-transferable, and subject to additional terms.
9. Intellectual Property
Eatling and all related content (excluding your User Content) are owned by us or our licensors and protected by applicable laws.
You may not copy, modify, distribute, sell, lease, or create derivative works from the Service unless we give you written permission.
10. Third-Party Services
The Service may integrate with or link to third-party services (e.g., app stores, analytics, health platforms). We are not responsible for third-party services, their content, or their policies. Your use of third-party services is governed by their terms.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The Service will always be available, uninterrupted, or error-free.
- Any insights will be accurate, complete, or suitable for your specific goals.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATLING AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $50 IF YOU PAID NOTHING).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Eatling and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from:
- Your use of the Service,
- Your User Content,
- Your violation of these Terms or applicable law.
17. Governing Law and Dispute Resolution
